In these Terms, “Red Seal”, “we”, “us” and “our” refer to the business operating under the Red Seal brand.

2. Website & Vehicle Information

Red Seal takes reasonable care to keep information on this website accurate and current. Vehicle details, specifications, kilometres, features, photographs and availability may be updated or corrected where necessary. Please confirm any feature or specification important to your purchase before entering into a sale agreement.

Japanese-market vehicles may differ in specification, equipment, software, navigation, infotainment, language settings and features from similarly named Australian-delivered vehicles. Descriptions are based on information reasonably available for the individual vehicle.

Where available, we review Japanese auction documentation, deregistration or export records, service records, recorded kilometres and other supporting information. Not every vehicle has undergone independent third-party odometer verification. Please ask about the documents available for a particular vehicle before purchase.

3. Pricing & Availability

Vehicle Price. Unless expressly marked “Drive Away”, an advertised price is the vehicle price and excludes applicable statutory and government charges, which may include stamp duty, registration-related charges and transfer fees.

Drive Away. Where expressly marked “Drive Away”, the displayed price represents the Drive Away price applicable to the advertised transaction, subject to the transaction details confirmed at the time of sale. Pricing type is set for each vehicle.

If an obvious typographical, data-entry or technical error affects a displayed price, Red Seal may correct it. Any final transaction remains subject to the written sale documentation and applicable law.

Listings are subject to availability; a vehicle may become reserved or sold before the website is updated. Submitting an enquiry does not reserve a vehicle.

4. Inspections & Vehicle Sales

Viewings and test drives are available by appointment at 142 Gray Street, Adelaide SA 5000. A valid driver’s licence is required for test drives. You may arrange an independent pre-purchase inspection through RAA, RAC or another suitably qualified inspector, subject to reasonable access arrangements.

Website content and the submission of an enquiry do not, by themselves, create a binding vehicle sale agreement. Purchases are subject to the applicable written sale documentation and disclosures, notices or requirements imposed by law. Any cooling-off rights are governed by applicable law and the written documentation for that transaction.

5. Deposits

Where a deposit is requested for a vehicle purchase or reservation, its amount, purpose and applicable refund or cancellation conditions will be communicated before payment and recorded in the relevant transaction documentation. Deposit arrangements remain subject to applicable law.

6. Vehicle Sourcing from Japan

Red Seal can search Japan for vehicles matching your requirements. An initial sourcing request does not commit you to bidding on or purchasing a vehicle. We may present candidates based on model, specification, kilometres, condition and budget. No auction bid is placed for a customer without that customer’s authority to proceed with the particular vehicle and agreed bidding parameters.

Any estimated Australian landed, complied, prepared or delivered budget uses information reasonably available at the time. Actual costs can vary with the auction price, exchange rate, auction fees, Japanese inland transport, shipping, port and import costs, compliance, preparation, government charges and Australian transport. Inclusions and exclusions should be confirmed in the sourcing documentation for that transaction.

If a deposit is required after a candidate and bid authority are agreed, its amount and treatment if a bid is unsuccessful will be set out in the applicable sourcing agreement. If Red Seal successfully purchases a vehicle under your authority, costs and contractual obligations may already have been incurred. If you then seek to cancel, some or all of a deposit may be non-refundable depending on the sourcing agreement, costs incurred and applicable law.

7. Finance & Trade-Ins

Red Seal may introduce customers to independent third-party finance brokers or providers. Finance is provided by the relevant third party, not Red Seal, unless expressly stated otherwise. Applications are subject to the provider’s eligibility requirements, assessment, approval, fees, rates and terms. Red Seal does not guarantee approval.

Red Seal may purchase or accept vehicles as trade-ins. Values depend on condition, kilometres, history, specification and current market conditions. Any preliminary estimate is subject to final assessment.

8. Interstate Sales & Transport

Red Seal sells vehicles to customers throughout Australia. Registration, roadworthy, inspection, stamp duty and other requirements vary by state or territory. Destination-specific requirements may need to be completed separately unless Red Seal expressly agrees in writing to arrange them.

We can assist with arranging interstate transport. Charges depend on the vehicle, destination and delivery method and are not included in the advertised vehicle price unless expressly stated.

9. Your Consumer Rights

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or other protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Consumer guarantees may apply to vehicles bought from licensed dealers and exist independently of any voluntary or extended warranty.

Second-hand vehicles sold by licensed dealers in South Australia may also be subject to statutory dealer obligations, including applicable duties to repair defects. Whether and for how long those obligations apply depends on the vehicle and transaction circumstances. Relevant statutory notices form part of the sale documentation where required.

10. Privacy & Website Use

Personal information submitted through this website is handled in accordance with our Privacy Policy.

Red Seal branding, logo, original copy and photography on this site are protected by applicable intellectual property rights. Third-party vehicle names and trademarks remain the property of their respective owners.

11. Changes to These Terms

Red Seal may update these website Terms from time to time. The current version and latest update date will be published here. Changes do not retrospectively alter an existing signed transaction except where agreed or permitted by law.

12. Governing Law

These website Terms are governed by the laws applicable in South Australia, Australia. This does not remove rights available to interstate customers under applicable law.
